1. About these Terms

These Terms and Conditions (“Terms”) apply to your use of totalsportsaustralia.com.au (the “Website”) and to all purchases from Total Sports Australia (“we”, “us”, “our”), whether made online, in our Penrith store or through our eBay store.

By using our Website or placing an order, you agree to these Terms. If you are ordering on behalf of a club, school or organisation, you confirm that you are authorised to do so.

Our approach. We would much rather sort out any problem with you directly and fairly than rely on fine print. These Terms are our safety net, setting out how things work and what happens if something goes wrong. 2. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these Terms or in any of our policies, including our Returns, Shipping and Warranty pages, excludes, restricts or modifies any right or remedy you have under the ACL or any other law that cannot lawfully be excluded. If anything in our policies is inconsistent with your rights under the ACL, your ACL rights prevail.

4. Products and information

We take care to describe and display products accurately. However:

  • product images are a guide only. Colours, finishes and natural materials (such as cricket bat timber and grain) may vary slightly from the images shown.
  • colours may appear differently depending on your screen
  • product specifications, sizing and availability are provided by manufacturers and may change without notice
  • stock levels shown on the Website are indicative, and stock is shared between our Website, store and eBay. A product may become unavailable after you order it. If that happens, we will contact you to offer an alternative or a refund for that item.

5. Pricing and payment

  • All prices are in Australian dollars (AUD) and include GST unless stated otherwise.
  • Shipping charges are calculated at checkout and are additional to the product price.
  • Prices and promotions may change without notice. The price shown at the time you place your order is the price you pay.
  • We accept the payment methods shown at checkout, which may include credit and debit cards, PayPal and buy-now-pay-later services. Card payments are processed securely by Stripe. In store, we accept the payment methods available at the counter.
  • Buy-now-pay-later services are subject to the provider’s own terms and approval criteria.
  • Your order is confirmed once payment has been received and accepted.
  • If we have made an obvious pricing or listing error, we may cancel the affected order and refund any amount paid for it.

6. Orders

  • When you place an order, you are making an offer to buy. A contract is formed when we dispatch your order or confirm it in writing.
  • We may decline or cancel an order, for example if a product is unavailable, if we suspect fraud, or if delivery is not possible to the address provided. If we do, we will refund any amount you have paid for the cancelled items.

7. Bulk, club and school orders

For bulk, club, school or team orders, please contact us for a quote. Quotes are valid for the period stated on the quote, and are based on the products, quantities and delivery details provided at the time. If any of these change, the price may change.

8. Custom and personalised products

  • Custom and personalised products, such as custom cricket bats and personalised jerseys, are made to your specifications.
  • You are responsible for checking that the details you provide, including names, numbers, spelling, sizes and specifications, are correct before you place your order.
  • Because these products are made specifically for you, we cannot accept returns for change of mind. If you have any other concern about a custom order, please contact us and we will discuss it with you.
  • By supplying names, logos or artwork, you confirm that you have the right to use them, and that we may reproduce them on your product.
  • We may refuse any request that we reasonably believe infringes third-party rights or is offensive or unlawful.

9. Shipping and delivery

  • Dispatch and delivery times, shipping options and costs are set out in our Shipping Policy. Delivery times are estimates only.
  • Please make sure your delivery details are correct. Additional costs caused by incorrect or incomplete addresses, or by failed deliveries, may be charged to you.
  • For oversized, bulky or bulk orders, please contact us for a shipping quote or to arrange store pickup.
  • Risk in the goods passes to you on delivery. If a parcel arrives damaged, or is lost in transit, please contact us as soon as possible and we will work with you and the carrier to resolve it.

10. Returns, refunds and warranty

Our change-of-mind returns, exclusions and cancellation terms are set out in our Returns & Cancellation Policy. Manufacturer warranty periods, care requirements and the claims process are set out in our Warranty Terms & Conditions.

If a product has a major failure, you are entitled to choose a refund or a replacement, and to compensation for any other reasonably foreseeable loss or damage. If the failure is not major, you are entitled to have the product repaired or replaced within a reasonable time. These rights apply in addition to any manufacturer’s warranty and to our Returns & Cancellation Policy.

11. Product use and safety

Sports equipment should be used for its intended purpose, with appropriate protective equipment, and in line with the manufacturer’s instructions and care requirements. Please check sizing and fit before use, especially for protective gear, helmets and children’s equipment. Natural products such as cricket bats require proper preparation and care, as described on our Warranty and service pages.

12. eBay and in-store purchases

Purchases made through our eBay store are also subject to eBay’s own terms and policies. Purchases made in our Penrith store are subject to these Terms and our policies as they apply to in-store sales.

13. Website chatbot

Our website provides a chatbot to help with questions and enquiries. It may use artificial intelligence or automated technology and may be operated by a third-party provider on our behalf.

Information you provide through the chatbot is handled in accordance with our Privacy Policy.

Chatbot responses are provided for general assistance only and may not always be accurate, complete or current. Prices, stock availability, shipping and product details are confirmed at checkout, on the relevant product page, or by our team in writing.

Chatbot responses do not constitute a quote or an offer to sell, and do not vary these Terms, our pricing or our policies. Where there is any inconsistency, written confirmation from our team, our website content and these Terms prevail.

Please do not enter payment card details, passwords or unnecessary sensitive information into the chatbot.

14. Your account

If you create an account, you are responsible for keeping your login details secure and for activity under your account. Please tell us promptly if you believe your account has been used without your permission.

15. Use of our Website

You agree not to misuse our Website. This includes attempting to gain unauthorised access, interfering with its operation, introducing malicious code, or using automated tools to copy its content or place orders.

All content on our Website, including text, images, graphics, logos and design, is owned by or licensed to Total Sports Australia or our suppliers. You may not reproduce it without our written permission. Brand names and trade marks of the products we sell belong to their respective owners.

Our Website may contain links to third-party websites. We are not responsible for their content or practices.

16. Limitation of liability

To the extent permitted by law, including the Australian Consumer Law:

  • we are not liable for any indirect or consequential loss, including loss of profit, revenue or opportunity, except where that loss was reasonably foreseeable and caused by our failure to comply with a consumer guarantee
  • we are not liable for injury, loss or damage resulting from misuse of a product, use contrary to the manufacturer’s instructions, or failure to use appropriate protective equipment
  • where our liability for a failure to comply with a consumer guarantee can be limited, it is limited, at our option, to replacing or re-supplying the goods or paying the cost of doing so, or refunding the price paid.

We handle your personal information in accordance with our Privacy Policy.

18. Resolving problems

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.

We may update these Terms from time to time. The version on our Website at the time you place your order applies to that order.
